Child Abuse Reporting

Michigan law requires:

• School administrators, teachers or counselors to report suspected child abuse or neglect immediately to the Michigan Department of Human Services (MDHS).  The 24 hour hotline number is 1-800-322-4822 for this region, and
• Within 72 hours afterwards, file a written report with MDHS.
• There is a lengthy list of others who are required to report, including physician, dentist, physician's assistant, registered dental hygienist, medical examiner, nurse, person licensed to provide emergency medical care, audiologist, psychologist, marriage and family therapist, licensed professional counselor, social worker, licensed master's social worker, licensed bachelor's social worker, registered social service technician, social service technician, a person employed in a professional capacity in any office of the friend of the court, law enforcement officer, member of the clergy, or regulated child care provider.
• A person on the staff of a school must also report to the head of the school, but
• Reporting to the head of the school does not discharge the obligation to report to MDHS.
• A required reporter who fails to do so may be charged with a misdemeanor and may be civilly liable for any damages resulting from failure to report.

The law provides immunity from civil or criminal liability:

• For persons acting in good faith
• Who are making a report, cooperating in an investigation, or assisting in any other requirements of law
• Including immunity for those who are not required to report.

The identity of a reporting person is confidential, and

The law prohibits retaliation for reporting or cooperating in an investigation.
